The Right to be Left Alone 05; Laptop Seizure DHS
New polices recently disclosed by the Department of Homeland Security (DHS) allows security forces at the airport to seize laptops and other devices capable of storing information in digital or analog form. These devices are allowed to be retained by DHS for an undisclosed amount of time. The information found on the laptop is allowed to be shared with other law enforcement agencies and is allowed to be taken off site to a laboratory at the agent’s discretion. The policy, which was recently upheld in the 9th Circuit court in San Francisco, allows for a person without suspicion of wrongdoing to have their property seized and retained by DHS.
